1. Introduction
Welcome to MP NIEVA’S FLOWER COMPANY. By accessing our website and purchasing our products, you agree to comply with and be bound by the following terms and conditions.
2. Products and Services
- Product Availability: All products are subject to availability. In the event that a product is out of stock, we will offer a substitute of equal or higher value.
- Product Variation: Flowers are natural products, and therefore, there may be slight variations in color, size, and appearance.
- Custom Orders: Custom orders require a minimum of 1 day notice. Prices may vary based on specific requests.
3. Ordering and Payment
- Order Placement: Orders can be placed online, @mpnievas facebook page, Grabmart, or in-store. Full payment is required at the time of order placement.
- Payment Methods: We accept PayPal, Gcash/Paymaya, or bank transfer.
- Pricing: All prices are listed in Philippine Peso and are subject to change without notice. Prices include applicable taxes unless otherwise stated.
4. Delivery
- Delivery Area: We deliver within Metro Manila. Deliveries outside this area may incur additional charges.
- Delivery Times: Standard delivery times are between 7AM – 8PM. We do not guarantee specific delivery times but will do our best to accommodate requests.
- Delivery Charges: Delivery charges apply and are calculated based on location.
- Non-Delivery: If the recipient is unavailable at the time of delivery, we will leave the flowers with a neighbor or in a safe place and inform you of the location. If no safe location is available, the flowers will be returned to our shop, and a re-delivery fee may apply.
5. Cancellations and Refunds
- Cancellations: Orders can be canceled up to 1 day before the scheduled delivery time. Cancellations made after this period may be subject to a cancellation fee.
- Refunds: Refunds will be issued for products that are damaged upon delivery or wrong item. Refund requests must be made within 2 days of delivery. Refunds are issued to the original payment method.
6. Returns and Exchange
Due to the perishable nature of our products, we do not accept returns or exchanges. However, if there is an issue with your order, please contact us within 1 day of delivery, and we will do our best to resolve the issue.
7. Privacy Policy
We value your privacy. Any personal information provided by you will not be shared with third parties without your consent.
8. Liability
- Limitation of Liability: We are not liable for any indirect, incidental, or consequential damages arising out of the use of our products or services.
- Force Majeure: We are not responsible for any failure to deliver due to circumstances beyond our control, including but not limited to natural disasters, strikes, or transportation delays.
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Philippines.
10. Changes to Terms and Conditions
We reserve the right to update or modify these terms and conditions at any time without prior notice. Your continued use of our services following any changes indicates your acceptance of the new terms.
